Terms of Service

Section 01

Scope of Work

PitchDart is an AI-powered sales outreach platform. When you use PitchDart, the service will:

  • Research your target prospects based on the criteria you define
  • Generate personalized cold outreach emails and multi-touch follow-up sequences
  • Queue and send approved emails through your connected email account or our proxy
  • Track open rates, reply detection, and sequence completion

Automated email sending: Campaign emails are sent automatically based on your configured campaign settings. When you enable Auto-Outreach or Full Auto mode on a campaign, PitchDart will research new prospects, generate personalized emails, and send them without requiring per-email approval from you. You remain in control via your campaign configuration — you can switch any campaign to Manual Approval mode in campaign settings to review and approve each email before it is sent. By enabling automated modes, you authorize PitchDart to send emails on your behalf according to your campaign criteria. You are responsible for all emails sent under your account, regardless of whether they were sent in automated or manual mode.

What PitchDart does NOT do:

  • Does not guarantee reply rates, meetings booked, or revenue generated. Email outreach outcomes depend on your offer, targeting, timing, and market conditions — none of which PitchDart controls.
  • Does not replace human judgment. AI-generated content should be reviewed before sending when using manual mode. You are responsible for the messages sent from your account in all modes.
  • Does not represent your business in legal, financial, or binding communications. PitchDart is a drafting and delivery tool — not an authorized representative.

PitchDart acts as a force multiplier for your sales process, not a substitute for it.

Section 02

Data Privacy & Security

Your data and your customers' data are yours. We treat them accordingly.

Encryption: All data is encrypted at rest (AES-256) and in transit (TLS 1.2+). Prospect data, email content, and campaign settings are stored encrypted in our database.

Data ownership: You own everything you bring into PitchDart — your prospect lists, your campaign content, your results. We do not claim ownership of any data you upload or generate.

No selling, no sharing: We do not sell, rent, or share your data with third parties for advertising or commercial purposes. The only exceptions are the infrastructure providers required to run the service (database hosting, email infrastructure), and only under strict data processing agreements.

Deletion: When you cancel your subscription, your data is deleted within 30 days. You may also request immediate deletion at any time by emailing support@pitchdart.com.

Regulatory alignment: PitchDart's data practices are designed to be compatible with GDPR (EU) and PDPA (Thailand/Singapore). We honor data subject access requests and deletion requests within 30 days.

Section 03

Payment & Subscription

Billing processor: Payments are handled by Razorpay. PitchDart does not store or process your payment card details directly.

Currency: Subscriptions are billed in USD globally and in INR for customers in India, based on your billing region.

Billing cycles: PitchDart subscriptions are billed monthly. Your subscription renews automatically on the same date each month unless cancelled.

Payment methods: We support automatic recurring payments and manual monthly renewal depending on your plan and region.

Cancellation: You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you retain access until then. There are no cancellation fees.

Refunds: Refunds are issued at our discretion for technical failures that prevented use of the service. We do not issue refunds for underutilization, change of mind, or dissatisfaction with AI-generated content quality (see Section 4). To request a refund, contact support@pitchdart.com within 7 days of the charge.

No hidden fees: The price shown at checkout is all you pay. We do not charge per-email, per-prospect, or per-campaign fees on top of your subscription.

Price changes: We reserve the right to change pricing with 30 days' written notice. Existing subscribers will not be charged more during their current billing period.

Section 04

AI Liability Disclaimer

Important: PitchDart uses AI to generate outreach content and research prospects. By using the service, you acknowledge and accept the limitations of AI-generated content described in this section.

PitchDart is not liable for:

  • Email deliverability. Whether emails land in inbox, promotions, or spam is determined by your domain reputation, sending history, recipient email providers, and content — not PitchDart's infrastructure alone.
  • Reply rates or conversion outcomes. No AI tool can guarantee that prospects will respond, book meetings, or become customers. Results depend on your offer, messaging, and market fit.
  • Lost business or opportunity cost. If a campaign underperforms, produces no leads, or damages a prospect relationship, PitchDart is not liable for the resulting business impact.
  • Downstream consequences of sent emails. Once you approve and send an email, you are responsible for its contents. If an email causes a complaint, unsubscribe, or spam report, PitchDart is not liable for the consequences to your domain or sender reputation.
  • Third-party platform changes. Email providers, spam filter algorithms, and deliverability standards change constantly. PitchDart makes no guarantees about results as these external factors evolve.

PitchDart's total liability for any claim arising from use of the service is limited to the fees paid by you in the 30 days prior to the claim. In no event will PitchDart be liable for indirect, incidental, consequential, or punitive damages.

Section 05

AI Hallucinations Disclaimer

AI models can produce inaccurate outputs. This is a known characteristic of all large language models, not a bug specific to PitchDart.

When PitchDart's AI researches prospects or generates email content, it may:

  • Generate contact information (names, titles, email addresses) that is incorrect or outdated
  • Make claims about a prospect's business, pain points, or context that are inaccurate or fabricated
  • Reference facts, statistics, or events that do not exist or are misattributed
  • Produce content that sounds confident but is factually wrong

Your responsibility: You must verify all AI-generated content before sending. This includes prospect contact details, personalization claims, and any specific facts referenced in emails. Sending an inaccurate or fabricated claim to a prospect reflects on your business, not ours.

PitchDart provides a preview and editing interface specifically so you can catch and correct AI errors before emails are sent. Using this interface to review content before sending is expected — not optional.

PitchDart is not liable for any consequences arising from AI-generated inaccuracies in sent communications, including but not limited to: reputational damage, prospect complaints, legal claims from third parties, or lost business relationships.

Section 06

Terms of Service

Agreement: By creating an account or using PitchDart, you agree to these terms. If you do not agree, do not use the service.

Eligibility: You must be at least 18 years old and have the legal authority to enter contracts on behalf of yourself or your organization.

Acceptable use: You agree to use PitchDart only for lawful sales outreach. You may not use PitchDart to:

  • Send spam, unsolicited bulk email, or messages that violate CAN-SPAM, CASL, GDPR, or other applicable anti-spam laws
  • Harass, threaten, or harm individuals
  • Distribute malware, phishing content, or deceptive communications
  • Scrape, reverse-engineer, or resell PitchDart's services
  • Violate any applicable law or regulation

Account responsibility: You are responsible for all activity under your account. Keep your credentials secure. Notify us immediately at support@pitchdart.com if you suspect unauthorized access.

Service availability: We aim for high uptime but do not guarantee uninterrupted service. Scheduled maintenance, infrastructure incidents, and third-party dependencies may cause temporary unavailability. We are not liable for losses due to service interruptions.

Modifications: We may update these terms at any time. We'll notify active subscribers by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance.

Termination: We may suspend or terminate your account for violation of these terms, fraudulent activity, or at our discretion with 30 days' notice. Upon termination, your access ends and data deletion follows the schedule in Section 2.

Governing law and jurisdiction: These terms are governed by the laws of Singapore, without regard to conflict of law principles. Any disputes will be resolved through binding arbitration in Singapore, unless prohibited by applicable local law.
